In recent months my office has seen a proliferation in road rage incidents involving commercial vehicles. As a Long Beach Criminal Attorney I see many cases stemming from port traffic in and around the shipping terminals of both Los Angeles and other areas. No one can dispute that big rig drivers have a tough job manuevering around freeways hauling important cargo and circumstances arise where other motorists agitate already stressed out truck drivers to the point that they may assault others with their truck. In these situations a felony may have been commited which carries up to four years state prison. In addition, any ADW involving a vehicle would result in the lifetime revocation of any drivers license in California.
It is important to note that an assault with a vehicle does not require any actual touching of the other party's car. For example a situation where a truck driver gets up behind another motorist to just scare the driver can result in an ADW charge being filed.
